| dc.description.abstract | La pensión de vejez es el beneficio supremo que adquiere el trabajador luego de años de trabajo y aportes al sistema, esto para beneficio de él y de su familia, pero es importante el evidenciar la necesidad de la heredabilidad de estos aportes que se constituyen en el beneficio real para quien ostenta la calidad de conyugue o compañera o compañero permanente de quien fallece y no había logrado adquirir el estatus de pensionado por su fallecimiento no alcanzó a cumplir con los requisitos para obtener la pensión o aquel que fallece y ya estaba disfrutando de este beneficio, esta línea jurisprudencial nos lleva a identificar los requisitos para obtener la pensión como cónyuge supérstite y la procedibilidad de la acción de la acción de tutela para lograr obtener dicho beneficio. | en_US |
